INXS...Band bosses dispute show in court

INXS band member Andrew Farriss did not believe that his band had done nothing since the death of the former lead singer, Michael Hutchence, in 1997, but agreed they had wanted to get back on top of the charts.

"Everyone wants a hit," the veteran rock musician told Supreme Court Justice Patricia Bergin, who is hearing a multimillion-dollar breach-of-contract case brought against the band by its former managers.

The court heard how at a working weekend in Coffs Harbour in January 2004, the band, a psychologist and the managers David Edwards and Michael Murchison worked out a plan to resurrect the band's glory days. An international reality TV show would find a new lead singer to try to fill Hutchence's shoes.

Mr Farriss said the idea for a reality TV show idea did not come from Mr Edwards - as Mr Edwards has said - but was first thought of by his fellow band member Kirk Pengilly in 1998. When asked by Mark Williams, SC, for the former managers, why he had not put that in his affidavit, he said he had focused on what had happened in the United States in the last weeks of the TV show, when the relationship with Mr Edwards had allegedly unravelled.

The court heard the band's New York lawyer sent an email to Mr Edwards after the hit Rock Star television show last year, saying "we want a divorce".

The two say they had written and oral agreements entitling them to 15 to 18 per cent of the band's income, including income from the television show, a world tour and a new record.

The initial estimate was for $7.5 million. In the year before their sacking, the managers' company, Odd Couple Productions Pty Ltd, was paid management commissions of $526,000.

Meanwhile, in the US, INXS is trying to have the contract declared invalid in the California Labour Commission, arguing that the managers were in breach of Californian law when they negotiated and helped produce the Rock Star show as they were not licensed as talent agents in California. The band yesterday sought to have the NSW proceedings stopped, arguing that any dispute must be dealt with in the US.

The parties agreed yesterday that if the case was to go ahead in NSW the band would preserve funds to pay Mr Edwards and Mr Murchison if they were successful.

Justice Bergin urged the parties to try to reach a settlement at discussions that were to be held last night. The hearing continues.
